MADISON, Wisc (Reuters) ? The Wisconsin Supreme Court should void a controversial state law curbing the power of public sector unions because a judge who ruled on the law had a conflict of interest, a county attorney said on Friday.
Dane County District Attorney Ismael Ozanne said in a court filing that Judge Michael Gableman should have recused himself from the case.
A divided Supreme Court in June allowed the union law to go into effect by a vote of 4 to 3 with Gableman in the majority. The court would have been deadlocked had Gableman recused himself.
The law set off a fierce national debate on the collective bargaining rights of labor unions and prompted a drive to remove from office nine Wisconsin state senators. Two Republicans who had supported the union curbs were recalled.
The law forced local workers such as teachers to pay more for health care and pensions, and limited the ability of their unions to negotiate wage increases.
Democrats and labor unions are leading a campaign to force a recall election next year of Republican Governor Scott Walker, who championed the union law.
The court filing on Friday said that Gableman should have recused himself because a lawyer who represented the Republican-led state government in the case had represented Gableman on a personal issue.
"Justice Gableman received legal representation from a private law firm, Michael Best & Friedrich, LLP in a personal legal matter without any obligation to pay legal fees," the court papers said.
The filing said that Gableman's personal lawyer, Eric McLeod, attended the oral argument before the state Supreme Court on the union law as a representative of the state government.
The filing asked the court to either void the law or force Gableman to recuse himself. Gableman has denied any wrongdoing.

FRIDAY, Dec. 30 (HealthDay News) -- Researchers have identified three gene abnormalities that appear to raise the likelihood for developing the thyroid cancer, with one in particular -- the PTEN gene -- implicated in children's risk for the disease.
Dr. Charis Eng, founding director of the Genomic Medicine Institute of Cleveland Clinic's Lerner Research Institute, said in a news release that her team's "investigation into the genetics behind thyroid disease raises important details relevant to diagnosis and treatment. We hope to promote the earliest diagnosis and most targeted treatment possible."
The researchers unearthed the gene-cancer risk link by examining and tracking roughly 3,000 patients, many of whom had already been diagnosed with a different disease called Cowden syndrome.
The study, published in the Dec 1. issue of the Journal of Clinical Endocrinology & Metabolism, focused on mutations in three genes: PTEN, SDH and KLLN. Because all work on distinct cell pathways, potential treatments to reduce cancer risk would have to target each gene individually.
Thyroid cancer has experienced the largest increase among both men and women of all cancers, according to the Cleveland Clinic release.
PTEN is a tumor-suppressor gene that, when healthy, aids in cell growth and division. Inherited PTEN mutations, however, impede the gene's normal function while spurring the growth of tumors. These abnormalities are known to be present in about 80 percent of patients with Cowden syndrome, who are considered at risk for developing breast and thyroid cancer.
The investigators concluded that mutations in the PTEN gene were indeed associated with a rise in thyroid cancer risk, with some early indications that mutations in the SDH and KLLN genes might also be implicated.
Children under the age of 18, however, seem to face a unique cancer risk dynamic: While PTEN mutations were seen to elevate their risk for thyroid cancer, SDH and KLLN abnormalities did not.
PTEN testing is already a staple in the world of genetic screening, the release noted.

Reid Ribble, a Wisconsin roofing contractor-turned-Republican lawmaker, has helped change the way Washington talks about the national debt. That?s not to say he has done much about the debt itself.
Nearly a year ago, Ribble and other newly elected House Republicans came to Capitol Hill on a single-minded mission to shove the federal debt to the top of the congressional agenda. They succeeded. At every opportunity, they demanded cuts in spending, forcing a series of white-knuckle showdowns that have kept the government in a state of perpetual crisis. Washington nudged close to a public conversation about the kind of government taxpayers want and what they are willing to pay for it.

Last week, however, Ribble went home for the holidays with little to show for all the political drama. The debt stood at $15.1?trillion, $1?trillion more than when he got to town. By the end of next year, projections show, it will grow by an additional $1?trillion. Ribble said he and his allies had cut spending for 2012 by only about $7?billion, a sliver so tiny Ribble could measure its impact in minutes.
?We?ve saved the American taxpayer about 17 hours of spending. That?s it,? he said. ?When you just really stop and think about it, we?ve made very little progress.?
Look past 2012, and the budget deals of the past year make a more significant dent. They reduce spending by more than $1?trillion over the next 10 years, the largest debt reduction in two decades. Yet no one, of any ideological stripe, is bragging about the accomplishment. Instead, the Capitol is pervaded by an atmosphere of failure, of opportunity blown.
Despite round after round of negotiations ? first over the operating budget, then over the federal debt ceiling and finally in the deficit ?supercommittee? that disbanded last month ?Republicans and Democrats never resolved the most fundamental budget questions: whether to raise taxes and how to control spending on an aging population.
There was some movement. Some Democrats, including President Obama, conceded that Social Security and Medicare pose a long-term threat if there are no constraints on benefits. Some Republicans, including House Speaker John A. Boehner (R-Ohio), declared themselves willing to talk about raising taxes, a break from the GOP?s long-standing and vigilantly enforced party line.
But Boehner was not able to lead his top lieutenants and unbending freshman class to embrace a compromise on taxes as a first step toward their debt-
reduction goals. In more than a dozen interviews, lawmakers and independent analysts blamed leaders in both parties for failing to seize the moment and then retreating to their respective corners to prepare an election-year assault on the ideas offered by the other side. Many expressed their frustration with an unusual candor that reflected exhaustion as well as disappointment.
?Both major political parties have not been honest about what it?s going to take to fix this,? said Sen. Mark R. Warner (D-Va.), who has led Senate efforts to forge consensus. ?Expectations of us are so low, if we could actually show we can put policy ahead of party, I think the reaction would be so positive.?

The US is prepared to admit the politically besieged president of Yemen, Ali Abdullah Saleh ? ostensibly for medical treatment ? following vigorous debate within the Obama administration over whether the move would be seen as support for an Arab despot with blood on his hands.
Saleh, who has ruled for 33 years, said at the weekend that he plans to travel to the US to end the political crisis that has claimed the lives of hundreds of anti-regime protesters in Yemen.
"I would like to get away from attention and TV cameras and allow the consensus government and the local authorities to prepare properly the upcoming elections," he said.
However, a dispute has broken out over the terms of Saleh's admission, with the US saying he will only be allowed in for "legitimate medical treatment" for injuries sustained in a bomb attack on his presidential compound in June.
Some in the US administration are concerned that Saleh is looking for a way out of his country to avoid prosecution for his army's slaughter of protesters earlier this year.
Washington does not want to be seen to be giving Saleh asylum or protection, but other administration officials believe his departure could open the way for an end to Yemen's political crisis.
Washington has one eye on the decision by President Jimmy Carter to allow the Shah of Iran to travel to the US in 1979, which contributed to the anger of Iranian revolutionaries who seized the US embassy in Tehran and took diplomats hostage.
Saleh said he only intends to go to the US for "a few days" and he "will not abandon my people and my comrades". But opposition activists believe that if he leaves Yemen in the present political climate, he will not swiftly return.
His opponents celebrated when he left the country for Saudi Arabi in June for treatment after the failed assassination attempt, but he returned home in September.
Following months of protests, Saleh signed an agreement last month to hand over powers to his vice president, Abed Rabbo Mansour Hadi, and leave office after next year's election in return for immunity from prosecution for crimes, including the killings of anti-regime protesters, during his rule.
The immunity deal has infuriated many of the regime's opponents, who say Saleh continues to wield considerable power through his relatives and political loyalists who retain office.
About 20 people were killed over the weekend in protests against the immunity deal in the capital, Sanna, and the southern city of Taiz.
Tens of thousands of Yemenis took to the streets of Sanna on Monday to demand Hadi's resignation over his failure to bring to justice those responsible for killing protesters.
The New York Times reported that the US had set conditions, including requiring an itinerary, for issuing Saleh a visa. Although those conditions have yet to be met, officials said Saleh could arrive in the coming days.
